Copyright Policy
What you may play in Club Live, Radio and Talky broadcasts, and what happens when a broadcast is reported.
This English version is the legally binding version of this policy. Translations are provided for convenience.
This policy applies to everything you broadcast on BiSChat, including Club Live, Radio and Talky. It explains what you may play and what happens when a broadcast is reported. It forms part of the BiSChat Terms of Service.
Version 1.1. Effective date: 1 October 2026.
1. What you may play
Only play videos, music and audio that you own, that you have a licence for, or that come from the BiSChat music library. This also applies to music inside your videos, and to anything you play out loud during a broadcast, for example from another phone or a speaker.
Popular songs and videos (from radio, Spotify, YouTube, films or sports matches) usually may not be broadcast without permission, even if you bought them.
Do not re-broadcast other people’s live streams, TV channels, films or sports matches.
You are responsible for everything you upload, play or broadcast, including obtaining the rights to it. BiSChat does not check every broadcast before it goes live, but we act on reports and remove infringing content as described in this policy. If you use content that you do not have the rights to, you are legally responsible for that use, including any claims, fines or costs that result from it.
To the extent permitted by applicable law, you agree to indemnify, defend and hold harmless BiSChat and Airsid LTD, and their directors, employees and partners, from and against any claims, demands, fines, penalties, damages, losses, costs and expenses (including reasonable legal fees) arising from: (a) content that you upload, play or broadcast; (b) your breach of this policy or the BiSChat Terms of Service; or (c) your infringement of anyone’s copyright or other rights.
This does not apply to the extent that a claim or penalty is caused by BiSChat’s own failure to meet its legal obligations. It does not limit any rights you have under the mandatory consumer protection laws of your country. If any part of this section cannot be enforced under the law that applies to you, it applies to the maximum extent allowed, and the rest of this policy remains in effect.
2. The BiSChat music library
Background music in Club Live and audio in Radio can only be chosen from the BiSChat music library. BiSChat only adds tracks that it is licensed to make available for use in broadcasts, including paid broadcasts.
Hosts cannot upload their own audio files.
3. Your declaration when you upload a video
Every time you upload a video to your Library, you must tick this statement and choose the type of rights you hold (own work, licensed, or royalty-free):
“I confirm that I own this file or have permission/a licence to play it publicly on BiSChat, including in paid broadcasts. I understand that infringing files will be removed and earnings from broadcasts that use them may be withheld.”
Videos uploaded before this declaration existed cannot be played until you declare your rights to them.
Each time you pick a video to play during a broadcast, the app reminds you: only play files you hold the rights to. We keep a record of each declaration and confirmation.
Before your first broadcast, after a strike, and whenever this policy changes, the app asks you to accept the following declaration by ticking a box. You cannot start a broadcast until you have accepted it.
Copyright Declaration. I acknowledge, represent and agree that:
- I have read and understood the BiSChat Copyright Policy (the “Policy”), which forms part of the BiSChat Terms of Service. The Policy prohibits me from broadcasting, playing or otherwise making available any video, music or other content unless I own it, I hold a valid licence or permission to use it, or it is provided through the BiSChat music library.
- I represent and warrant that all content I upload, play or broadcast on BiSChat complies with the Policy and does not infringe the copyright or any other rights of any third party.
- I am solely responsible for the content I upload, play or broadcast. To the extent permitted by applicable law, I agree to indemnify, defend and hold harmless BiSChat, Airsid LTD and their directors, employees and partners from and against any claims, demands, fines, penalties, damages, losses, costs and expenses (including reasonable legal fees) arising from my content or my breach of the Policy, as set out in the Policy.
- Nothing in this declaration limits any rights I have under mandatory consumer protection laws that apply to me.
- I make this declaration knowingly and voluntarily, without pressure from anyone, and I understand that BiSChat keeps a record of it.
4. How to report infringement
If you believe a broadcast on BiSChat uses your work without permission, use the report option in the broadcast and choose “Copyright”. If you are not a BiSChat user, or the broadcast has ended, email us using the contact below.
Please include:
- (a) your name, postal address, phone number and email address;
- (b) the work you believe is being infringed;
- (c) the broadcast or file concerned (name of the broadcast or host, their PIN if known, and the date and time);
- (d) a statement that you believe in good faith that the use is not authorised by the rights holder, their agent or the law;
- (e) a statement that the information in your report is accurate and that you are the rights holder or are authorised to act on their behalf; and
- (f) your physical or electronic signature.
We aim to review copyright reports within 24 hours. We may stop a live broadcast immediately while we review it.
We may share your report, including your name and contact details, with the host so that they can respond.
Knowingly false reports may lead to legal liability, and we may stop handling reports from anyone who repeatedly sends unfounded reports.
5. Strikes and account suspension
Broadcasts reported as infringing may be stopped, the files concerned removed, and the earnings from those broadcasts withheld. We will tell the host what was removed and why.
Each confirmed copyright report counts as one strike. A strike expires 90 days after it is given. If you have 3 active strikes, your account will be suspended. We may suspend an account sooner for serious infringement, such as re-broadcasting a film or sports match.
After a strike you will be asked to confirm the broadcast rules again before your next broadcast.
6. Appeals
If you think a report against you is mistaken, or you hold the rights to the content, you can appeal within 14 days of being notified, in the app or by email to the contact below. Explain why, and include any licence or proof of ownership.
We will review your appeal and tell you the outcome. If we accept it, we remove the strike, restore the file and release any held earnings.
If the person who reported you starts legal action, we may keep the content down until that is resolved.
7. Earnings hold of 14 days
Biscoin earned from broadcasts can only be withdrawn 14 days after it is earned, so that copyright reports can be reviewed first. Earnings from a broadcast under review may be held until the review is complete. If a copyright report is confirmed, the Biscoin earned from that broadcast is cancelled, will not be paid out to the host, and is returned to the viewers who paid it.
